Terms and Conditions

These terms and conditions govern your use of the Primacare Pharmacy website (www.primacarepharm.com) and your relationship with Primacare Pharmacy when using this website. Please read them carefully as they affect your rights and obligations under the law. Use of this website will be governed by the laws of Nigeria and subject to the exclusive jurisdiction of the Nigerian courts.
The Primacare Pharmacy website will operate within the Nigerian PCN Pharmaceutical Service Regulations. You may be required to register as an authorised user of the Primacare Pharmacy website and agree to these terms and conditions. Acceptance of these terms and conditions does not affect your statutory rights.

1. Use of the Primacare Pharmacy website

The Primacare Pharmacy website is provided for your personal use. Primacare Pharmacy have taken every reasonable care in preparing the content of this website. However, Primacare Pharmacy disclaims all warranties of any kind with regard to the content services and products contained on this website. Primacare Pharma Ltd, its Directors and employees shall not be liable for any losses or claims arising directly or indirectly from the use of this.
Any links to other websites or providers of information in any medium are provided for interest only. Primacare Pharmacy accepts no responsibility or liability whatsoever for their content. Such links do not imply our endorsement of any content or product. The Primacare Pharmacy website is provided without any warranties or guarantees - you must bear all the risks associated with the use of the Internet.

2. Amendments

We may update these terms and conditions from time to time and any changes will be notified to you by an announcement on the Primacare Pharmacy website. Your continued use of the website would indicate your acceptance to be bound by the revised terms and conditions.

3. Registration

To register with Primacare Pharmacy you must be over sixteen years of age. You must ensure that the details provided by you on registration or at any time are correct and complete. You must inform us immediately of any changes to the information that you provide when updating your personal details. We are registered in compliance with the PCN Act.

4. Availability of the Primacare Pharmacy website

Access to the Primacare Pharmacy website cannot be guaranteed and your access may be occasionally restricted to allow for fault repairs, maintenance, or the upgrade of new services and products. Primacare Pharmacy will attempt to restore the website as soon as it reasonably can.

5. Advice

The information supplied on the website does not substitute for professional medical advice. You should always read all labelling and product information sheets before taking medicines of any kind. The content of this website must not be used as a method of diagnosis. If you have a medical condition or have any symptoms of a medical condition you are very strongly advised to consult your doctor without any delay.

6. Buying from our website

The content and products contained within this website are directed solely at those who access the site from Nigeria. Primacare Pharmacy is only able to deliver to a Nigeria address. Please note: Online prices only and store prices may differ.
Any order placed by a customer is only an offer to purchase which Primacare Pharmacy may in its absolute discretion accept or decline without having to provide a reason. Notwithstanding that payment has been made by the customer online and may have been processed, Primacare Pharmacy reserve the absolute right to refuse to supply the products and in such cases are not obligated to provide a reason for declining the order. In such cases a refund will be provided to the customer within a reasonable period of time by the same method as payment received. All prescriptions are delivered by first class recorded delivery. Primacare Pharmacy cannot accept any responsibility for prescriptions or orders which are delayed or lost due to the couriers fault.

7. Your security

Primacare Pharmacy takes online security very seriously and you can use our website with confidence. We use a secure server which encrypts your credit card information during transmission. Your card details are transferred over a secure virtual private network (VPN) to an authorisation server which is not directly connected to the Internet. Your card details are then entirely deleted from our systems after the transaction has completed.

8. Deliveries

Postage and packing is currently charged at 500NGN per transaction within Port Harcourt; cost of delivery anywhere else in Nigeria is determined with the location. Any orders over 10000NGN including VAT and prescription medicines are delivered free of charge. Please note, heavy/bulky items may be subject to extra delivery charges. In this event, we will contact you and advise you accordingly.

Deliveries are normally dispatched by a partner logistics company and can take upto 0-5 working days we will inform you by e-mail of the method of dispatch. Please note that all prescription medicines are dispatched by recorded delivery and will require a signature. It is the customer's responsibility to ensure that an authorised person is available to accept such a delivery.
The customer shall inspect the items immediately upon receipt and must notify Primacare Pharmacy within seven calendar days of any discrepancy or any damaged goods.
Primacare Pharmacy reserves the right to refuse sales at our discretion if we believe there is a fraudulent credit card use. You may be asked to provide further proof of your identity and/or proof of credit card. Failure to do so will result in termination of the transaction.
You will be notified by email if Primacare Pharmacy cancels your order or if your credit card has been declined. For security reasons, Primacare Pharmacy will log your IP address. Details of all fraudulent transactions will be passed on to the relevant authorities.

9. Returns policy

If, within seven calendar days, you no longer require all or part of your order, providing that the product remains unopened and in its original packaging, the item may be returned at the customer's cost for a full refund. Due to the nature of our business and potential health and safety this does not apply to any medicines, food products or meal replacements which may not be returned.

10. Limitation

You may not use the Primacare Pharmacy website for any of the following purposes:

  1. circulating any unlawful, harassing, abusive, obscene or otherwise objectionable material
  2. gaining unauthorised access to other computer systems
  3. interfering with any other person's use or enjoyment of the Primacare Pharmacy website
  4. breaching any laws concerning the use of public telecommunications networks or systems
  5. interfering or disrupting networks or other websites connected to the Primacare Pharmacy website
  6. making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.

11. Miscellaneous

If any provision of these terms and conditions is found to be invalid by any court having jurisdiction the invalidity of that provision will not affect the validity of the remaining provisions contained within these terms and conditions which shall remain in full effect.
Primacare Pharmacy may cancel your registration at our reasonable discretion or if you breach any of your obligations under these terms and conditions.
